Several shareholder classes filed lawsuits accusing former UnitedHealth's directors of failing in their fiduciary duty to properly notify shareholders of the scheme.......it was announced that McGuire would step down immediately as chairman and director of UnitedHealth. McGuire remained as chief executive officer through December 1, and was succeeded by Stephen Hemsley (then president and chief operating officer, and a member of the board of directors). , McGuire received compensation from UnitedHealth in the form of stock options that eventually became worth around $1.6 billion....

IMO, by the time CMS has done hair cutting and taming this beast, they won't have much buy back / repurchase cash to spend. CMS is going to gut either united or Humana like a fish. The MAPD programs in both are costing billions now the AI is eating popcorn.

You may well be right about that. Congress has long had its hands in the pockets of the big healthcare companies.

You know how huge of a company this is? Break up how exactly? These Congress guys will be paid off well before any company break up happens. 

What if the authorities--or Congress--feel it might be a good idea to break up the company? If what the Guardian says is true, it sounds to me as if there could be serious conflicts of interest.

Once again. I think the concerns are way over blown.

There are several things the company can do. I am looking at investing in this company. I do not think this is a sell and run away. The time to sell was in March before this hit.

1) the company can simply reduce the share repurchase agreement. UnitedHealth Group has authorized the purchase of up to $5 billion worth of its stock. The company was even talking about adding to the program. The stock is half what it was when this was implemented. This means the program is twice as effective. They could easily reduce the repurchase agreement or slow it down to set aside money for fines. UNH has Billions of dollars it can access to pay fines, etc.

2) The P/E is also a huge support at these levels.

3) There is a huge dividend to support prices.

Essentially, if this gets to a P/E below 9 there is no reason not to own for the dividend and wait for the smoke to clear.

Those secret bonuses have been paid out as part of a UnitedHealth program that stations the company’s own medical teams in nursing homes and pushes them to cut care expenses for residents covered by the insurance giant.

In several cases identified by the Guardian, nursing home residents who needed immediate hospital care under the program failed to receive it, after interventions from UnitedHealth staffers. At least one lived with permanent brain damage following his delayed transfer, according to a confidential nursing home incident log, recordings and photo evidence.

“No one is truly investigating when a patient suffers harm. Absolutely no one,” said one current UnitedHealth nurse practitioner who recently filed a congressional complaint about the nursing home program. “These incidents are hidden, downplayed and minimized. The sense is: ‘Well, they’re medically frail, and no one lives for ever.’”

That too. If UNH survives in the long run, it'll be a miracle, I think. And if it recovers, that won't happen for a pretty long time. I haven't been following closely, but it really is a mess.

The DOJ investigation was just announced. It'll probably take years to play out. It'll be very expensive, and there will be news about it appearing frequently. None of that is positive. And the payoffs to nursing homes sounds as if it resulted in unnecessary deaths. That's never a Good Thing.

The company is protesting that the DOJ has decided not to prosecute:

"The U.S. Department of Justice investigated these allegations, interviewed witnesses, and obtained thousands of documents that demonstrated the significant factual inaccuracies in the allegations," the company said. "After reviewing all the evidence during its multiyear investigation, the Department of Justice declined to pursue the matter."

Not to mention Tariffs on imported medication and the effects of prescription drug pricing being fixed on certain medications.

We really need to see updated price to earnings estimates from UNH with those risks accounted for.

This is not about the company surviving. We just do not know enough for me personally to step in and buy.

There are a lot of unknowns which need to be resolved.

Seems that way, since there appear to be both SEC and DOJ investigations underway.

Agree the stock/company will be fine long term. But It is just not investable until the price gets lower (atleast to me). I am watching it. There are a lot of unknowns which need to be resolved. IE drug pricing, Tariffs, etc. There are just better alternatives until the price goes down to a range where I am willing to carry this as a long-term investment.

Once again, I agree the reaction to the news an overreaction. I just want the stock to fall lower before I am willing to purchase.

I'm convinced the people who report on Medicare have no idea what they are talking about. Even officials. Uniteds advantage program as well as other insurers takes the risk off of the government by insuring the sickest patients. People enroll into.the plans because it saves them thousands each year compared to original Medicare. If you opened up advantage sick cohorts to Medicare the gov would be spending probably 25% more money than it does now, or $200b more annually. The advantage players get paid for the work they do and will get even more money forward looking. That's $2t saved in 10 years because of United and others. United advantage enrollment should be up 50% by 2030. There is no way they are doing fraud, but rather maximizing the intake on cms rules. Original Medicare does provide greater flexibility to conumers, but less overall medical help and well being.

The value this company brings to seniors is immense. The only thing to happen here is methodology changes by cms as to how advantage insurers get paid. They and others are pushing the limits on the allowed cms rules for payment. What you have is sick people on these plans who cannot use original Medicare because they can't get a supplement due to underwriting. Therefore cms is going to have to pay advantage players even more money. Huge profits ahead. No fraud. If sick advantage cohorts were able to go back to Medicare and a supplement you'd see the cost to Medicare per enrolle far surpass an advantage enrollee. Right now the cost to the gov is more on advantage per enrollee purely because the sickest have to stay on advantage in almost every state except for MA and CT.

Get a bunch of calls. These companies admin Medicare supplements and drug plans for no profit and half of consumers have them. If anything big pay increases to advantage are due and even larger profits. It's a program that saves most on them tons of money compared to supps...
