Intellisync Infringement Lawsuit Against Extended Systems Progresses Toward April Trial SAN JOSE, Calif., Feb. 26 /PRNewswire-FirstCall/ -- Intellisync Corporation , a leading provider of synchronization and mobilization software formerly known as Pumatech, is progressing toward its April trial date in its infringement lawsuit against Extended Systems (ESI) . The trial court is scheduled to hear a number of pre-trial motions on February 27, but Intellisync is confident that it is on track to go totrial in April. If Intellisync prevails against ESI, ESI would be unable to continue to sell certain of its synchronization products without Intellisync's permission and would be required to pay damages to Intellisync. ESI has not brought any substantive counterclaims against Intellisync in the infringement lawsuit. Intellisync expects to take four patents to trial, which are unaffected by the recent actions in the U.S. Patent and Trademark Office (PTO). Intellisync believes that these patents are sufficient to establish ESI's infringement. As is common in infringement actions, ESI requested that the PTO reexamine some of the patents at issue in the lawsuit. The PTO has confirmed that two patent claims in Intellisync's '664 patent are valid, but has rejected the other claims in the three patents undergoing reexamination. With respect to these patent claims, Intellisync will work aggressively to overcome the Examiners' actions. Regardless, Intellisync will continue with its business strategy that has made it a leading provider of synchronization and mobilization software.
