Feb 15 (Reuters) - LogMeIn Inc's quarterly results beat analysts' estimates, but the software maker forecast a weak first quarter and warned about increasing litigation expenses relating to a patent infringement case, sending its shares down 5 percent in extended trade.

The litigation costs relate to LogMeIn's defense against certain patent infringement claims made by Canadian software maker 01 Communique Laboratory Inc in September. "The litigation costs associated with defending the claims are increasing as the company progresses further in the discovery process and enters the trial phase," LogMeIn said in a statement.

LogMeIn, which helps users access their desktops from other devices, sees litigation related costs of about $3 million in each of the first and second quarters of 2011 and about $8 million for the full year. The company forecast first-quarter adjusted earnings of 13-14 cents a share, on sales of $26.3 million.

Analysts on average were looking for first-quarter earnings of 15 cents a share, on sales of $26.9 million, according to Thomson Reuters I/B/E/S.

For October-December, the company earned 28 cents a share, excluding special items, while analysts had expected 24 cents.

The Woburn, Massachusetts-based company's shares, which have gained 55 percent in value over the last six months, were down $1.89 at $38.20 in extended trade. They closed at $40.09 on Tuesday on Nasdaq. (Reporting by Saqib Iqbal Ahmed in Bangalore;Editing by Vyas Mohan)

Software company 01 Communique Laboratory wins patent ruling over Citrix Systems



Canadian Press DataFile Via Acquire Media NewsEdge) TORONTO _ Shares of Toronto-based communications software company 01 Communique Laboratory Inc. (TSX:ONE) got a lift after the company won a patent ruling over Citrix Systems.

The technology firm announced Friday that the United States Patent and Trademark Office issued a Right of Appeal Notice which concludes that all of the company's claims are patentable.

At issue was Communique's remote-access solution called ``I'm InTouch'' which provides users with remote access and control of data found on their home or office PC through an Internet connection.

Communique has said the company received a patent for ``I'm InTouch'' in August 2005, and Citrix later went to the market with its similar product called ``GoToMyPC.'' It has had concerns with another Citrix product as well.

A legal action was launched by Communique in 2006.

Sept 9 (Reuters) - Canadian software maker 01 Communique Laboratory Inc (ONE.TO) on Thursday filed a lawsuit against Dell Inc (DELL.O) and LogMeIn Inc (LOGM.O) alleging infringement of a patent on which it won a ruling against Citrix Systems (CTXS.O) in July.

Shares of 01 Communique rose as much as 17 percent on Thursday but pared some of their gains to close up 2 Canadian cents at C$1.64 on the Toronto Stock Exchange.

The company's shares have risen more than seven fold since the favorable ruling in the Citrix case.

01 Communique has identified a number of companies which have products that are making use of its patent, Chief Executive Andrew Cheung said in a statement.

"We will proceed accordingly as we endeavor to protect our intellectual property and build revenue," he said without identifying the infringing companies.

Later on Thursday, the company also reported a wider third-quarter loss hurt by lower contract engineering fees.

In the May-July quarter, loss widened to C$348,047, from C$250,983 a year ago. Revenue for the quarter fell 30 percent to C$84,307.

PATENT MATTERS

The patent in question, which is used in 01 Communique's "I'm In Touch" product, relates to a remote access software technology which allows computers and other devices to connect securely over the Internet.

As per the lawsuit filed in the United States District Court, Eastern District of Virginia, 01 Communique is seeking past and future damages, as well as a trebling of damages for willful infringement and injunctive relief from Dell and LogMeIn.

The Mississauga, Ontario-based company alleged that its software was used in remote access products like LogMeIn Free, LogMeIn Pro(2) and LogMeIn Ignition for LogMe In, and Dell Remote Access for Dell.

In July, the U.S. Patent and Trademark Office ruled 01 Communique's patent was infringed upon by Citrix's GoToMyPC, and GoToMeeting products.
