(NYSE:NTY), (http://www.nbty.com/), a leading global manufacturer and marketer of nutritional supplements, today announced that its President and Chief Financial Officer, Harvey Kamil, has adopted a prearranged stock trading plan to sell a portion of his company stock over time as part of his individual long-term strategy for asset diversification and liquidity. The stock trading plan was adopted in accordance with Rule 10b5-1 of the U.S. Securities Exchange Act of 1934 and NBTY's policies with respect to insider sales. Rule 10b5-1 allows corporate officers and directors to adopt written, pre-arranged stock trading plans when they do not have material, non-public information. Using these plans, insiders can gradually diversify their investment portfolios, can spread stock trades out over an extended period of time to reduce any market impact and can avoid concerns about whether they had material, non-public information when they sold their stock. Under his Rule 10b5-1 plan, which was effective as of August 6, 2007, Mr. Kamil may sell up to 818,285 shares of NBTY stock (including shares to be issued upon Mr. Kamil's stock option exercise) over a period of approximately two years. The plan allows up to 200,000 shares of NBTY stock to be sold per month, starting from February 2008 until February 2010, subject to certain price restrictions. If the target prices are achieved and all stock eligible for sale under the plan is sold, Mr. Kamil will still own approximately 1% of NBTY's current outstanding stock.
