I gotta agree. Unless your cost average is well below .75, I don't think a firesale of the company is the way to go and would ripoff a lot of long time holders here. I understand the frustration though, given the radio silence from Sarissa.

Sleven….their request for a “strategic review” is code for hire an Investment Banker to bring credible bids to the shareholders…they suggest a starting price of $.75/share and hopefully get more…these guys are probably in the stock at a good price and a sale price of $400 million ($1.00/share) gets them a double….they want the Board (versus Sarissa) to put the company “in play”….it’s up to the shareholders to accept or reject a bid….all these boys want is an announced bid and requisite move in stock price…..they won’t be around to see if the shareholders accept it….following these bottom fishers will not result in premium price, IMHO..

Why would anyone have held onto AMRN after the Judge Du decision? Anyone with experience investing in pharma knows that one product companies thst lose exclusivity are toast. Hoe much time and money have people on this board wasted on AMRN.

Finally we maybe get an activist investor who openly admits they are evil.

Sleven, I did some digging today. Neither of them exist in IAPD, so they are not registered investments advisors. Their firm is also not listed. So it's not a U.S. based registered investment advisor.
I followed some of the SEC filings they've made with other investments. It's a bit confusing. 
It's almost like they're attorneys or something else, communicating on behalf of clients. I can't quite piece it together yet.

Pro, I spent the afternoon reading up on their involvement in other companies. I don't think a simple request is the end of this. I don't know what they are trying to accomplish. I am fairly confident we will see more from them.

Lol The charts are like a news service telling you what has already happened. He will never tell you what the stock will be 3 days from now based on the charts.

Yeah, and it keeps coming up cause the "Denner is down big with his own money in this and just like me" crowd keeps bringing up how he's lost big money on this trade and needs to score a big win to finally make money above his initial buy in and hanging on hoping that'll happen. He doesn't. He isn't like you. It isn't his own money, it's a line item in his fund's holdings. He doesn't have a $4/sh bag. He actively trades this both ways. He has more access to company info than you do and will trade on it. He closes his books annually and reports to his holders ("Hey crew, tough year with Amarin but we restructured our position there and ultimately made $X in these other positions so net, we're all still up"... his guys are happy, doesn't do much for the retailers does it) while you're personal losses are exactly that, personal. His "shareholders" are big money like him, not common stock retailers. His math on this trade is nothing like yours. He can absolutely find a win for himself here that shafts every last retailer that thinks they've all got a common interest and he wont think twice about doing so if it makes him money. He will illegally trade if he thinks he can get away with it, he's been caught before. On top of all of that, no matter what happens, he and his crew are still getting their 2 and 20 on his AUM if Amarin succeeds or fails. Denner is getting paid no matter what. Meanwhile, all his Board pals get quarterly checks and get shares that dilute you more each quarter.

I would guess and hope Sarissa will respond rather than tempt shareholder legal action and or a proxy battle to unseat them. It is damning that part of their argument to replace the prior BOD was share decline and shares are now down 80% since they took over. Also BS that they failed to acknowledge the $50m approved buyback in the last update. I disagree with the speculation that Sarissa has ever had a short in the name (they have shorted very little in the history of the firm) or that they are interested in taking the company private (also something they have never done and don't have a mandate for).

DAR53 please see the below 13D filing for cost of sarissa's last buys during Nov. of 2023. Avg. CB is mid .70cent. Total ownership 33,470,000=8.2%.

RMB, the issue I see with Amarin's public response will be a word salad. They can't say anything material without filing an 8K. Maybe JEC will ask for a board seat. There's very little information in the public domain about JEC Capital Partners, and no website either which I find strange. I wonder who "some of their affiliates" are? The address appears to be a private residence. It seems the 2 guys representing JEC are professional disruptors. Just sayin

Those transactions have been discussed on this board before. So he did some financial gymnastics to get his cost basis down and to offset some gains that you seem to be aware of, not at all unlike any other entity or person would do to minimize tax obligations, ending up with the same number of shares he started with.

RMB, here's an interesting connection Bradley Radoff was on the BOD of Enzon Pharma at the same time Odysseas Kostas, MD was on the BOD my search shows they left at the same time in 2020.

Interesting too because the letter urged them to respond publicly. We will have to wait and see if there is any response. My mind quickly went to the idea about what if these guys had penned and sent this letter a couple of months ago, maybe we wouldn't have had to resort to a RS.

jroon, your short thesis is way off base. If your short theory is accurate AD would be in deep dodo for rigging the price of the stock and only hurts his financial returns keep in mind he has investors to answer to. Regarding Sarissa's ownership transferring from one prime account to another is a simple process especially since everything is done electronically through ACATS (automated customer account transfer service). Selling in one acct and buying back in another just can't be done without impacting the share price.

As long as he still controlled the shares, that effectively means he didn't "sell". So yes, transferring shares between accounts may have required "technical" sells, but if he immediately re-bought in other accounts, then he still maintained control.

I personally believe that Sarissa is the one that has maintained the short position over time, but really no way to prove that. I just look at the short interest that has existed through every price point of the stock the past 12-18 months, and I can't imagine why someone (other than Denner) would not close their short position when the SP got down into the 0.40's. I think the short position served two purposes; one, it made him some money. But more importantly, it allowed him to control the price over time.

The short interest has hovered between 16-20M shares without fail, for the past year. And for most of that time, it was between 17M and 18M shares, even as the share price cratered. It just doesn't make much sense why any reasonable investor would still have that position open.

And I suspect, when Denner wants the stock price to start running, you will see that short position start to evaporate.

We do know that his initial entry into AMRN was for 24+M shares at a CB of around $4.50/sh. He bought another 9M shares but I don't recall the CB. I think in the $2. + range. His cost basis today is shown as $1.58 so he has taken advantage of some trades to get his CB much lower.

JRoon, does moving shares amongst his various sub accounts equate to selling the stock short? At any time is the total number of shares owned the same?

Also, if you take his statement about shorting the stock at face value, then shouldn't you also take his statement that he has never sold the stock the same way?

I have no idea about whether he has shorted the stock or not, but I haven't seen compelling evidence either way. Me taking my shares out of my IRA as an RMD and putting it into my brokerage account for instance I would not consider selling or selling short the stock.
